Police Standing Order

The Standing Orders in Police are issued from Superintendent of Police to Inspector General of Police. Just we are discussing the following aspects of Standing Orders issued by the Inspector General of Police as Police Head of Province/ Head of Police Organization in the province. This Article is written by Dr. Mustafa Kalhoro, Taagrraai, LL.B/LL.M/Ph.D only to share the legal knowledge with the police personnel/ members of Sindh Police etc that they could be able to get incentive from these time limited orders which are existing and applicable for only five years unless otherwise they are extended or re-issued, however, the existing applicable orders are also appended with this Article.

Meaning:

  1. Standing Order: means Executive Order, Instructions, Guideline, Procedure, Distribution of work, Administrative directions.

Definition:

  1. Noun: A promulgated order which remains in force until amended or cancelled.

Legality:

  1. Article 12 of Police Act, 1861:-       Power of Inspector General to make rules.

       The Inspector General of Police may from time to time subject to the approval of the 16[Provincial Government], frame such orders and rules as he shall deem expedient relative to the organization classification and distribution of the Police force, the please at which the members of the force shall reside and the particulars services to be performed by them their inspection the description of arms. Accoutrements and other necessaries to be furnished to them; the collecting and communicating by them of intelligence and information; and all such other orders and rules relative to the Police force as the Inspector General, shall from time to time, deem expedient for preventing abuse or neglect of duty, and for rendering such force efficient in the discharge of its duties.

  1. Rule 14.55 of Police Rules, 1934.

(I)                An English file of all standing orders issued by the superintendent of police shall be maintained by the reader. An Urdu translation of each such order shall be kept in a duplicate file, and each such file shall be indexed. These files shall be continuous for five years, after which all orders not previously cancelled, and which it is necessary to keep in force, shall be re-issued, and fresh files shall be started. As soon as possible after the 1st January in each year the reader shall send to the lines and each police station a list, prepared from his file index, of all current standing orders which should be on record (vide rule 22.53), and shall be responsible for supplying duplicate copies of any which may then be found deficient. The repeal of a standing order shall be noted in the index and communicated by the reader to all concerned. Modifications shall be notified to all concerned when ordered and the original order shall be corrected accordingly.

(II)             All general orders of permanent character affecting the duties, procedure and practice of the police, explaining the rules of the department, the effect of the decisions of the courts, or of the law, as affecting offences, offenders and the police, shall be recorded in these files. Standing Orders for permanent guards, additional police Posts, etc, Shall not be included.

(III)           Every standing order shall be submitted to the Deputy Inspector General for approval before issue. If the order is one affecting departmental procedure on a point of General application and is approved by the Deputy Inspector General, a copy shall be sent by him to the Inspector General.

(IV)           Deputy Inspector General shall check files of districts standing orders and those issued by themselves (vide rule 1.6) at their inspection.

  1. Rule 22.53 of Police Rules, 1934:-

Comments:

Matter of promotion of in-service candidates in Police to the posts of ASIs standing order on the ground of Policy to recruit Nature and propriety. Question of Respondent/IG Police by way of standing order in question specifying the conditions of eligibility of serving Constable and Head Constable in the Police for competing in the selection of ASIs fixed an upper age limit of 33 years. Write petition in High Court assailing the impugned standing order Validity. Impugned standing order was neither approved by the Provincial Government nor notified in the official Gazette. Consequently it did not have the status of rules. Impugned S.O under the said Article could be no better than an executive order and must therefore yield to the legal requirements imposed by applicable statutory rules. The express statutory mandate for departmental promotion of in-service candidate to the post of ASIs was the for selection to be made through P.P.S.C Upper-age limit for in-service candidates to the assessed by the P.P.S.C. was 35 years. Impugned standing order was insofar as it prescribed 33 years as the upper-age limit for induction of in-service candidates was declared to be violative of the rules and therefore without lawful authority and of no legal effect. Writ petition partially allowed.     2006 LN (Lah) 1384 (a).

The Standing order contemplated in the said article is an administrative directionmeant to control and regulates the functioning of the police. 2006 LN (Lah) 1384 (a).

POSTS OF PC (DRIVER)/PC (COMPUTER OPERATOR) & PC (LANGRY)

Lately Training Institution of Sindh Police has reported acute shortage of Driver, Computer Operators and Langry/ cook to the extent that day to work is adversely affected.

2.        Now therefore to overcome this shortage of emergent nature it is hereby ordered that following number of post of Police Constable (BS-05) are hereby reserved / earmarked in categories of PC (Driver) PC (Computer Operator) & Pc (Langry) for training institutions as mentioned against each below:-

(i)       PC Driver (BS-05)

           Total number of posts =80

(ii)      PC Computer Operator (BS-05)

           Total number of posts =80

(iii)     PC Cook/ Langry (BS-05)

           Total number of posts =170

3.        Lien of above post in Police officers / units is indicated at Annex “A” of this Standing Order.

4.        The educational and other qualification for the post of PC (BS-05) in above categories shall be same as prescribed for the post of PC (BS-05) except that physical standard may be as below:-

           PC-Driver                                             -           Minimum Heights 5.4” and above

           PC-Computer Operator                        -           Minimum Heights 5.4” and above

           PC/ Cook-Langry                                 -           Minimum Heights 5.3” and above

  1. The number of posts earmarked above shall be in addition to existing sanctioned posts under these categories. The personal appointed against posts covered under this standings Order shall be restricted to respective specialized categories to Training Institutions only and under circumstances be entitled to transfer or assignment to General Police duty as Police Constable.
  1. All personnel appointe or adjusted against the post indicated in this Standing Order shall undergo skill training course of three months at PTC Saeedabad Karachi in respective categories i.e. driver Computer operator and cook /Langry in addition to basic recruit course.

Subject: – One step promotion in own pay and scale

 

                        In order to fill in vacancies in training institution / technical posts as well as to recognize exceptional and meritorious service in the under mentioned spheres the grant of one step promotion (in own pay and scale) may be PPO Sindh under stipulated conditions:-

(i)                 Against posts in Training Institutes.

(ii)               Against Technical where suitable personnel are not readily available.

(iii)             Personnel working in CID/Special Branch for meritorious performance.

(iv)             Higher Qualification MA/PHD (up to the rank of ASI).

(v)               Gallantry.

(vi)             For providing actionable intelligence against terrorists.

(vii)           Representing and winning in sports at National International Level.

The one step promotion will be subject to the following conditions:-

(i)                 The recipient of promotion will not be entitled to any financial benefits.

(ii)               He/ She will not have any claim to seniority by virtue of the out of turn promotion and will maintain seniority in his / her original rank.

(iii)             He/ She will not be assigned of SPO, SHO, SIO, unless he/ she is senior most among first five percent) in original rank. (Example) if he is posted as SPO on one step he must be among the first five percent of senior most Inspector of the Region)

(iv)             The promotion of officials who are granted one step promotion will be regularization on turn alongwith his. Bath mates and the inter-se-seniority will not be disturbed.

(v)               The one step promotion in own pay and grade is performance oriented and the recipient be reverted in rank by the DPO, DIG, RPO, if he fails to perform his outies efficiently.

In partial modification of this office Standing Order No. 239/2010 dated 25.05.2010 modified vide order No. AIGP/OPS/18923-24/2009 dated 01.10.2010 and amended by AIGP/OPS 19053-19116, the following amendments are hereby ordered.

  1. After the conversion of SP Security-I into AIG Security, SsP Security-II, III, and IV are renamed as SsP Security-I, II, and III respectively.

NEW UNIFORM OF SINDH RESERVE POLICE.

 

                     Henceforth the new uniform of Sindh Reserve Police fromthe rank of Police Constable to Police Inspector will of the following pattern:

The trouser will be of “Jungle Green” colour.

  1. PATTERN

The trouser will have six pockets on it: Two (02) pockets in front, two (02) side and two (02) on the back (hip pockets). Pocket will have inbuilt tuck-ins as well as elastic in the belt area making stretchable and comfortable.

  1. TECHNICAL SPECIFICATION.

RE-ORIGNIZATION OF TAINING BRANCH:-/In pursuance of Government of Sindh Home Department Notification bearing No. POL,HD, 6-1/95 dated 22.09.1998 & in exercise of the power under Article 10 (03) r/w Article 27 of Police Order 2002 the organization structure of Training Branch is re-organized with immediate effect and is declared as a separate cadre to the extent as under:-

Training branch will maintain own seniority lists A-I, B-I, C-I, D & E lists & make promotions from the rank of PC up to SI after due process DPC in accordance with rules like all other Regional Heads.

(D)    TRAINING / POSTING.

 

(i)     Transfer of Officers / men posted to Training Branch from one to another Training Center will be made only by the Addl: IGP / Sindh & DIGP / Training as per authority envisaged to them. Existing Rule of transfer amongst different cadres will apply.

STANDING ORDER NO. 245/2010

 

ESTABLISHMENT OF ESTATE MANAGEMENT BRANCH

 

  1. ORGANIZATION

               There shall be an Estate Management Branch in the Provincial Police Headquarter as an integral part of the Provincial Police headed by an officer of the rank of Assistant Inspector General of Police (hereinafter referred to as head of the branch) who shall be assisted by such number of senior and junior rank and ministerial staff as determined from time to by the Provincial Police officer.

 

  1. INTERNAL ADMINISTRATION ETC.
  2. Subject to the overall control of the Provincial Police Officer, the internal administration of the branch shall vest in the head of the branch.
  1. The head of the branch may issue circulars inconsistent with the Police Order 2002and the Police Rules for the efficient working of the branch.
  1. Police officer posted to the branch shall have the same administrative financial disciplinary powers as available to the Police Officers of the equivalent rank in the field.
  1. Police rule shell be applicable to the Estate Management Branch in all matters including accounts office work transport equipment and wireless etc.
  1. OFFICERS

               The branch shall have Provincial and District officers. The District Office shall be headed by an Estate Officer not below the rank of Inspector. The Estate Officer in the district shall work under control of the DPO/SP Town (the latter being the custodian of Police property in the district). He will however coordinate with AIG Estate Management in all matters and keep AIG Estate Management informed through regular reports. The AIG Estate Management shall also countersign the ACRs of officers in the rank of ASI/SI while ACRs of Inspector will be countersigned by DIG HQ.

  1. POSTING TO THE BRANCH.

               All officers of senior and junior ranks shall be posted to the Estate Management Branch from regular cadres. Police officers of junior ranks shall be posted for a period of 3 years which may be extended for a further period of one year at the discretion of the head of the Branch.

  1. PROMOTIONS.
  2. A Police officer posted to the Estate Management Branch shall retain his original seniority in the cadre of his district or region. While service in the Estate Management Branch he shall eligible for temporary promotions in that Branch. On reversion from the Estate Management Branch, he shall assume his original place in the cadre.
  1. When an officer born on the role of a district or region reaches a place in senior which would entitle him to be considered for substantive promotion if he were serving in the establishment to which he belongs permanently he shall be informed and given opportunity returning to his parent unit. No officer while posted to the Estate Management Branch shall be substantively promoted unless both the head of the Estate Management Branch and the concerned Regional Police Officer agree to such promotion.
  1. The head of the Estate Management Branch may make recommendations to the Regional Police Officer and the Provincial Police Officer respectively for promotion or admission to list-F of Sub-Inspector serving in the Department. A Sub-Inspector who becomes eligible for promotion while serving in the Estate Management Branch shall receive such promotion if Regional Police Officer and the head of Estate Management agree to such promotion.
  1. FUNCTION

The functions of the Estate Management Branch shall include the following:

  1. Maintenance of the record of Police lands and Police buildings.
  2. Maintenance of the record of land produce and building rents etc.
  3. Inspection/supervision of existing lands and building.
  4. New Constructions/alterations etc (Maintenance of record and Inspection on behalf of CPO)
  5. Major repairs.
  6. Revision/enhancement of return of Police properties (through a committee to be appointed by the PPO).
  7. Removal of encroachment from Police Land a legal process)
  8. Removal of unauthorized occupants from Police buildings (by adopting a legal process)
  9. Acquisition of new Lands for further planning (through a committee to be appointed by the PPO)
  10. Ensuring timely payment of dues concerning utilities by the occupants of Police buildings.
  11. All legal matters concerning Police Lands.
  12. Interaction/liaison with Excise and Revenue Authorities.
  13. Enter in Revenue record the name of Police Department as owner in respect of properties which are in possession of the Police Department but are not registered (title) in the name of Police Department.
  14. Set up/subscribe to a Google Program with the assistance of IT Section to monitor encroachment on Police properties and ensure legal action by RPO, CCPO, DPO, for their removal.
  15. Keeping of photographs of all the properties.
  16. Any other matter entrusted by the Provincial Police Officer.
  1. LEGAL AFFAIRS

               The Legal Unit at the district and provincial Police Headquarter shall render all legal advice and assistance required in Land disputes and litigation in the courts as well as in other matters at the discretion of the head of the branch.

  1. EXPENDITURE.

               Reasonable amount of expenditure incurred on the activities regarding efficient discharge of functions by the Estate Management Officer and other officers including expenses on civil suit connected with Estate Management Branch shall be defrayed by the head of the branch from the assets fund with approval of the Provincial Police Officer.

  1. INSPECTIONS.
  2. The head of the branch shall conduct inspections of District Estate Officer on half yearly basis unless necessitated otherwise.
  3. All record pertaining to Lands and buildings shall be thoroughly checked and a certificate shall be given that on unauthorized alterations in the records have taken place.
  4. The record shall be physically checked with actual Lands and buildings to ensure that on unauthorized use of occupation thereof has taken place and a certificate to that effect shall be given by the inspecting officer.
  1. ACTION AGAINST IRREGULARITIES

               Any irregularity coming to the notice of the branch whether through inspections or otherwise shall be promptly reported by AIG Estate Management to DIG HQ for necessary administrative or legal action as the case may be.

ESTABLISHMENT OF CANIN UNIT IN SINDH POLICE

There shall a canine Unit in the Garden Police Head Quarter as an integral part of the Bomb Disposal Unit Special Branch, Sindh Headed by an officer of the rank of Deputy Superintendent of Police who shall be assisted by such number of junior rank staff as department from time to time by the Provincial Police Officer.

  2. The overall control of canine Unit shall be with the Superintendent of Police Security Special Branch Sindh.

The Canine Unit shall assist BDU in the search of explosive devices and materials in accordance with SOP.

The Canine Unit shall have office in Police Headquarter Garden Karachi. In addition to other administrative powers the SP Special Branch shall also countersign the ACRs of officers in the rank of ASI/SI while ACRs of Inspector will be countersigned by DIG, Special Branch (Security), Sindh.

All junior ranks officers shall have to undergo Dog Handler Training and subsequent certification by a committee headed by DIGP Special Branch and comprising of the following members;

  2. DSP (I/C), Canine Unit.

The officials who do not pass dog handler training will not be retainer in Canine Unit.

 

 

 

 

  1. PROMOTIONS.

  2. This Standing Order shall come into force with immediate effect.
  1. OBJECTIVE

To recognize the sacrifice rendered by Shaheed and to extend relief to the bereaved families of Police officials who lost their lives in the line of duty.

  1. DEFINITION

(a)                Shaheed means Police personnel who lost his life in the line of duty as a result of an act of terrorism / target killing, encounter with criminals and also includes Traffic Police Officials on traffic duty who are deliberately over run and killed by a vehicle of any kind.

(b)               A legal heir means son/ daughter /widow/brother or sister.

(c)                Board means body of members duly constituted to conduct test/Interview.

 

  1. ELIGIBILITY.

(i)                 A legal heir means son/ daughter /widow/brother or sister. Who laid down his life in the line of duty as a result of act of terrorism/ target killing, encounter with criminal also include, traffic officials on traffic duty killed by vehicle of any kind. In case there is no son/daughter /widow of the Shaheed, brother/ sister of the Shaheed can be consideration in order of preference.

(ii)               Only on claim shall be given to the legal heir of the Shaheed.

(iii)             Only persons domiciled in Sindh Province shall be eligible for recruitment against Shaheed Quota.

  1. QUALIFICATION.

Requirement will be the same as per regular appointment of Male/Female candidates.

  1. RECRUITMENT COMMITTEES.

The Recruitment Committees shall comprise of:-

The Managing Committee shall get conducted annual inspection of firearms / weapons in all units of Sindh Police for repair & refurbishment. The Committee shall identify the firearms / weapons needing service / repair. The concerned unit shall transport all such firearms / weapons to and from SPARRU at own expenses. The expenditure incurred on repairs will be catered for from relevant head of account by CPO.

CONSIDERATION OF COMMENDATION CERTIFICATE IN PROMOTION.

In order to maintain a balance rewards and punishment and to alleviate severity of exceeding punishment affecting promotion of otherwise eligible junior rank personal it is ordered that henceforth commendation certificate awarded to junior rank personal shall carry certain counterbalancing effecting major / minor punishment. In this regard, the Departmental Promotion Committee shall carry out Punishment exclusion exercise as per following guidelines while considering promotion of junior rank officers to the next higher rank (fro Constable to Inspector):

  1. Three CC-I awarded by PPO shall nullify one major punishment.
  1. Four CC-I awarded by CCPO/RPOs or five CC-II jointly shall undo one major punishment.
  1. One CC-I awarded by CCPO/ RPOs or three CC-II shall aside any ongoing minor punishment at the time of DPCs consideration.

In this regard, the DPC must take into account the following conditions:

  • Both commendation certificate (s) and major punishment (s) must pertain to the rank from which promotion to the next higher rank is being considered.
  • Only commendation certificates awarded on meritorious performance, good investigation and extraordinary duty shall carry neutralizing effects against punishments.
  • The commendation certificates awarded by authorities other then PPO Sindh, after initiation of promotion process (i.e. issuance of letter calling for recommendations in respect of to-be-considered Police Personnel) shall not be valid for consideration in the current DPC.
  • The department process of appeal against particular major punishment must have exhausted.
  • In the case of more than one major punishment maximum of two punishments shall be rescindable.
  • The benefit of commendation certificate shall not be extended to police officers who have been punished for involvement heinous criminal and corruption cases or ordinarily a bad reputation.
  • The commendation certificate shall not be used to set aside punishment of dismissal/discharge from service /compulsory retirement. Conversely, they shall not be a bar awarding punishment to delinquent police officers.
  • The commendation certificate once redeemed in a DPC shall not be valid for further similar consideration. An entry to such effect shall be made in the service book of the beneficiary reflecting the number (s) and date (s) of commendation certificate (s) against which particular punishment (s) has /have been struck down.

CREATION OF SINDH POLICE SERVICE BOARD

 

In order to keep of retired police personal with a view to ensuring their welfare and usage in emergencies, elections and assistance in crime eradication Sindh Police Service Board (hereinafter SPSB) is established with the following specifications:-

 

 

The offices of SPSB shall be located in provincial and regional Police headquarters. An officer of the rank of DSP shall be the in-charge of Provincial office while regional offices shall headed by officers of the rank of Inspector. The Provincial SPSB shall work under supervision of AIGP welfare while in the regions ADIGP welfare shall have overall supervision of the board.

 

 

The charge of SPSB shall be assisted by two Constables and one Junior Clerk possessing sufficient computer skill to efficiently maintain database of retired police personal.

 

The offices of SPSB shall be equipped with computer printer and telephone. The provincial in-charge shall be allotted a pickup mobile while regional in-charge will be given motorcycles.

 

 

 

 

 

 

SPSB shall carry out of the following responsibilities:

  1. Maintenance of record along with their current residential addresses.
  2. Invite police personal on occasions such as Eids, Bara Khana, Sport events and other festivals / ceremonies.
  3. Obtain inputs / feedbacks regarding crime situation in their area of dwelling etc.
  4. Obtain consent for employment in Sindh police welfare security service.
  5. Prepare and launch schemes for the welfare of retired police personnel.
  6. The DPOs / SsP Town and SsP Investigation shall provide a copy of retirement notification along with CNIC, current address and contact number to SPSB office and shall update any changes in the status.

Since all police personnel perform sensitive duties and are often deployed for duty with weapons it is essential to assess their suitability from the psychological point of view. This assessment will be in addition to verification of character and antecedents by operation Police Special Branch and Intelligence Bureau.

2.                                 All concerned Addl. IGPs, CCPO, RPOs and DIGs should arrange to carry out psychological assessment of all police personnel at the stage of recruitment training as well as for in service personnel through Committees comprising of the following:-

(i)                 DID/SSP.

(ii)               SP

(iii)             SP

3. Personnel who are assessed as unsuitable should not be deployed on any kind of duty nor should personal be detailed for training courses (including recruits course). Under no circumstances weapon should be given to any Police official who is assessed as unsuitable.

4.                                 Personnel who are assessed as unsuitable should be put through a proper psychological test through a panel of psychologists.

Forensic Examination Requirments to be met by the Invetigation units of Sindh Police.

With the view to improve the outcome of forensic Division following steps will be taken by the SSP Investigations of Sindh duly supervised by the District Police Officers.

  1. All case properties of firearms exhibits are to be referred to forensic Division expert opinion immediately after their recovery.

(i)        Fingerprint cards prepared by AFIS Remote Terminals (R.Ts)in district to be prepared in duplicate and one set to be sent to the MEWS in Forensic Division Sindh Police Karachi for checking of previous criminal record of the suspects.

(ii)      Search slips in from No. 13 should be prepared by I.Os and sent to Forensic Division for record purpose.

(iii)

(iv)    The I.Os also prepares ten print slips of unidentified dead bodies and sends to Forensic Division for identification.

(v)

(vi)    Every district prosecution branch to send convict slips from No.26 (2) A to Forensic Division for permanent record.

  1. Other physical evidences involving evaluation of Questioned Documents and the restoration of erased Serial number on vehicles are either delayed or not given attention by the Investigation Officers. This should be ensured.
  1. The disputed documents to be examined should properly labeled and encircled in original should be sent to Forensic Division immediately for opinion.
  1. Sized vehicles suspected to be stolen will not be released unit they are put through the process of FSL test which will be conducted by vehicle unit examiners of Forensic Division Sindh. The vehicle examiners will ensure their visits district headquarters regularly on the request of the DPOs to carry out the examination.

TASK TO BE CARRIED OUT DAILY ENGINE OIL LEVEL:-

Before starting engine daily check for level between F and L marks on gage rod. Oil level should not be above F (Full) mark.

TRANSMISSION OIL LEVEL:-

Before operation daily check transmission oil level. Remove driver’s access panel. Add oil as needed to bring oil between ADD and FULL marks on gage rod. With engine disconnect engaged start and run engine at 800 –rpm for 3 to 5 minutes with shift lever in 2-3 and brakes locked to allow transmission oil to reach normal operating temperature. With engine idling move shift lever through all ranges to assure complete circulation. Return shift lever to N, and check transmission oil level with engine operating at 1500 rpm.

TRANSFER GEAR CASE

Daily check of oil in transfer gear case. Add oil as needed to bring oil level between ADD and FULL marks on gage rod.

 

DIFFERENTIAL OIL.

Before operation daily check differential oil level to be sure there is enough oil for warm-up operation. Add oil only if level is below safe range. Add oil as needed.

TRACK ADJUSTER:

Daily visual check to condition of track and track adjuster. Maximum limit of track adjuster 17 inch between mounting screws.

RADIATOR COOLANT:

Daily check that coolant level is within ½ inch of bottom of filter neck.

TASK TO BE CARRIED OUT WEEKLY FINAL DRIVES:

Weekly check oil in both final drives for level between ADD and DULL marks on gage rod.

PIVOT STEER FLUID LEVEL:

Remove plugs and weekly check fluid level in both master cylinders.

RAMP HYDRAULIC FLUID:

With ramp down and carrier on level ground weekly check hydraulic fluid level. Fluid level should be halfway in sight glass

FAN GEARBOX OIL:

Weekly check fan rear box oil level. Add as needed to bring oil level to center to of sight glass.

AIR FILTER ELEMENTS:-

Clean elements weekly.

UNIVERSAL JOINTS:-

Check weekly Every 150 hours 1500 miles of semiannually lubricate all universal joints and propeller shaft bearing. Each universal joint spider has two fittings but only one of each pair of fittings requires lubrication.

TOWING PINTLE:-

Check weekly Every 150 hours 1500 miles of semiannually lubricate pintle through two fitting.

STEERING CONTROL LEVER:-

Check weekly Every 150 hours 1500 miles of semiannually lubricate steering control leve shaft bearing

 

RAMP WIRE ROPE:-

Check weekly every 1500 miles of semiannually lower ramp and clean exposed portion of wire rope. Wipe off excess oil. Remove rear plate raise ramp and clean concealed portion of wire rope. Wipe of excess oil.

 

 

OIL CAN POINTS:-

Check weekly every 1500 miles of semiannually or as required lubricate ramp hinges ramp door hinges power plant door hinges trim vane hinges and latches drivers commanders and cargo hatch control linkage pins and shafts and seat control. Lubricate air box heater air motor.

Check weekly. Lubricate every 150 hours 1500 miles of semiannually using grease gun with flexible adapter. Fill hubs with grease lubricant until lubricant escapes through relief valve.

TRANSMISSION OIL FILTER :-

Replace filter element each time a transmission oil change is required every 150 hours 1500 miles or semiannually.

TWO CABLE:-

Every 1500 miles or semiannually and after each uses clean cable with brush and oil wipe off excess oil.

TACHOMETER AND SPEEDOMETER SHAFTS:-

Semiannually clean lubricants.

RESPONSIBILITIES

 

MAINTENANCE:-

The APCs are at the disposal of Regional Police Officers and they are competent to allocate them to their districts on the need basis. However maintenance shall be the responsibilities of the head of the unit /district under whose command the APC is being used. This shall be supervised by Regional Police Office concerned through Regional MTO.

WILLFUL DAMAGE:-

If any damage is being caused to the APC the Regional Police Officer shall appoint a committee under Zonal DIsGP to action the responsibility. Once the damage / any fault is proved as willfully caused the defaulter shall be punished severely and the cost incurred on the repair of such damage should be recovered from defaulter.

  1. To receive investigate hear make finding and recommend action on complaints against the Police officers alleged for the use of excessive or unnecessary force abuse of authority discourtesy or the use of offensive language.

METHOD OF WORKING

  1. The complaint Cell is headed by DSP to be named as DSP Complaint Cell. He/she will be directly under the command of PPO Sindh through AIG Operation. DSP Complaint Cell Should Further distribute the staff (Ministerial and Executive) according to their subjects distribution for smooth working so that there should be no confusion about the responsibility and no delay is that there should be no confusion about the responsibility and no delay is caused.

 

  1. Complaints may be made by any person whether or not that person is a victim of or witness to an incident. All the complaints / petitions received in the cell through or witness to an incident. All the complaints / petitions received in the cell through mail email facsimile or verbal via telephone call which is addressed to the PPO Sindh shall deem to have been received directly by Complaint Cell.

 

  1. DSP Complaint Cell will scrutinize all the complaints and maintain a separate register for inward entries of the following complaints:-

(a)    Complaints received from President Secretariat, Prime Minister Secretariat Governor Sindh and Chief Minister Sindh.

(b)   Complaints received from Home Minister Office Chief Secretary and Home Department.

(c)    Complaint received through ordinary mail, e-mail, fax or telephone calls.

(d)   Matters entrusted by the superior and subordinate judiciary.

  1. DSP Complaint Cell will then mark the complaint / petitions to any one of the Police Officer on the penal of Complaint Cell or send it to the RPOs/ CCPO Karachi, Zonal DIsG, DIG/Investigation DIG/Traffic, DPOs/SsP etc. in accordance with the existing procedure.
  1. The enquiry officers after receiving such petition will call the petitioner directly or visit him at the given address confirm the contents of the petition and allegations leveled therein and proceed further. He should complete the enquiry and submit report through DSP Complaint Cell to AIG/Operations within stipulated time for further orders.
  1. Complaint Cell will maintain a log of the orders passed thereon and will also keep on record the action taken on the recommendation of the enquiry officer. A summary of such action taken should be submitted to PPO Sindh on fortnightly and monthly basis through AIGP/Operations.
  1. Similarly, a return of the enquiries conducted and complaints under process should also be submitted on fortnightly and monthly basis to PPO Sindh on through AIG/Operations.
  1. Every enquiry officer will be held responsible if any victimization comes to notice. Enquiry officer should ensure that impartial enquiry is conducted and justice is provided to the public at any cost.

DUTIES OF DSP COMPLAINT CELL

  1. Direct supervision of the Complaint Cell staff.
  2. Ensure proper administration so that the Complaint Cell staff should work within their domain and the Complaint Cell functions smoothly.
  3. To distribute the load of work evenly.
  4. To ensure justice and fair play.
  5. To ensure proper maintenance of record and act custodian of the record of the Complaint Cell.
  6. To submit enquiry reports to AIG/Operations on daily basis.
  7. To submit fortnightly and monthly statement of Complaints disposed off and Complaints under process to the PPO Sindh through AIG/Operations.
  8. To submit fortnightly and monthly feedback regarding the action taken on the recommendations of the enquiry officer or the orders passed by the senior officers.
  9. Any other duties assigned by the PPO Sindh.

 

DUTIES OF AIG OPERATIONS

  1. Overall supervision of the Complaint Cell.
  2. Ensure timely disposal of the reference received in the Complaint Cell.
  3. Ensure smooth functioning of the Complaint Cell by providing them necessary resources.
  4. To maintain discipline of the Complaint Cell.
  5. To submit fortnightly and monthly return to PPO Sindh.
  6. Any other task assigned by the PPO Sindh.

  1. AIG Security will issue Security Orders for the visits and movements of VVIPs and will be responsible for the implementation of such plans / orders relating to SSU.

In exercise of the powers under Police Rule it is ordered as under:-

  1. OBJECTIVE.

The objectives of establishment of Vigilance Cell at Range levels are as follows:-

(i)                 Identifying and effecting corrective action of Police Department personal against practices that negatively affect the quality of life of general public.

(ii)               Taking appropriate action so that misconduct of a few will not tarnish the overall reputation of Police Department as protector of life property and honour of general public.

(iii)             Protecting the Police against false and malicious allegations / enquiries.

(iv)             To restore public confidence in Police make it to work efficiently and to inculcate a sense of responsibility and accountability at various levels.

  1. COMPOSITION OF VIGILANCE CELL.

The Addle: IGP Crime Branch Sindh will be the overall In charge of the Vigilance Cell in Sindh under the direct supervision of Inspector General of Police Sindh.

  1. CHARTER OF DUTIES.

(i)                 The vigilance Cell will perform their duties only on the directions of IGP Sindh. They will not initiate any of the proceedings at their own.

(ii)               Informal Inspections of Police Stations Traffic and Licensing Offices District Police Lines SSsP, SDPO Offices, DSPs Traffic District Wireless Control and motor Transport Offices of Sindh Police (in their respective areas).

(iii)             Discreet / Fact finding enquiries into:-

(a)    Rampant / persistent complaints of corruption.

(b)   Gross miscarriage of Justice.

(c)    Police inaction in important / high profile / sensational cases.

(d)   Police high handedness / torture death in custody and other violations of basic human rights.

(e)    Escape from police custody indicating police involvement / connivance.

(f)    Police encounters alleged to be fake.

(iv)             To verify police performance particularly with regard to action taken against P.Os / Absconders Cattle lifters and Anti Social elements during campaigns.

(v)               To check and verify whether important instructions issued by the Inspector General of Police Sindh from time to time are being implemented in letter & spirit.

(vi)             To investigate the allegations of use of force torture and abuse of power by Police Officers.

(vii)           To investigate the allegations of discrimination bias and favoritism on the basis of religious belief or any other consideration.

(viii)         To investigate the allegations of intra-departmental misconduct including sexual harassment and complaints involving hostile and unfriendly work environment.

(ix)             To look into persistent report of non-registration of cases.

(x)               To enquire into the allegations of misuse of Govt. funds / vehicles / facilities etc.

(xi)             To verify the complaints of indifference to Welfare of Police personnel.

(xii)           To verify the observance of Police Station Inspection Schedules, holding of Weekly parades and Orderly Rooms Establishment of Line’s School and Line’s Inspection.

(xiii)         To check and verify whether action is being taken on reports / recommendations of vigilance Cells all over Sindh.

(xiv)         Any other task assigned by the Inspector General of Police Sindh.

  1. WORKING PROCEDURE.

(i)                 On receipt of information / complaint regarding the subjects listed under the head Charter of Duties, Inspector General of Police Sindh will issue order to Addle: IGP Crime Branch Sindh through AIGP Operations. The Addle: IGP crime Branch Sindh shall direct any Member of Vigilance Cell to carry out discreet or open enquiry to ascertain facts as they deem appropriate depending on the nature of complaint / information.

(ii)               The members of Vigilance Cell shall verify the complaint / information and accomplish the within the specified period and submit report to the Additional IGP Crime Branch Sindh as the case may be. If necessary the member may also visit the area to which a particular complaint pertains.

(iii)             Separate files about each complaint / incident and inspection carried out by the Vigilance Cell shall be maintained & quarterly report shall be submitted to the Inspector General of Police Sindh through their respective chain of command.

(iv)             The order regarding departmental action against defaulter police officers / officials shall be passed by the respective chain of command in accordance with the directives contained in Police rules.

(v)               A quarterly progress report will also be submitted to the Inspector General of Police Sindh for evaluation of performance of each tier of command under them.

  1. RESPONSIBILITY OF ADDLE IGP CRIME BRANCH SINDH.

(i)                 He will monitor all disciplinary proceedings initiated on the report of the team at his level.

(ii)               He will submit report to the Inspector General of Police Sindh for taking action against the Police officers.

(iii)             He will issue directives to all concerned to co-operate during internal investigations / enquiries with the officer / of the team.

(iv)             He will be responsible to submit monthly and quarterly progress report to the Inspector General of Police, Sindh and ensure compliance of the orders passed by the IGP Sindh on the reports.

(v)               Any other task assigned by the IGP Sindh.

  1. DUTIES OF THE ALL DIGsP.

(i)                 They will examine the reports prepared by members of Vigilance Cells and submit to the Addle: IGP Crime Branch Sindh with their observations.

(ii)               They will keep close liaison with other units of Police Department and report facts to the Inspector General of Police Sindh with the suggestions to improve the situation in a particular area.

(iii)             They will monitor all disciplinary proceedings initiate on the reports of Vigilance Cells.

(iv)             They will issue directives to all concerned to co-operate during internal investigations / enquiries with the officer / officers of Vigilance Cells.

(v)               Any other task assigned by the Inspector General of Police Sindh.

(vi)             They will be responsible to send monthly and quarterly progress reports to the Addle; IGP Crime Branch Sindh and ensure compliance of such orders at their respective levels.

  1. DUTIES OF THE INCHARGE AND MEMBERS OF THE VIGILANCE CELLS.

In charge and members posted in inspection and vigilance cell at range levels shall perform the following functions:-

(i)                 They will carry out discreet / fact finding enquiries entrusted to them by the Inspector General of Police Sindh through Addle: IGP Crime Branch Sindh or AIGP Operations.

(ii)               They will keep track of all the matters under enquiries in their unit and their satisfactory conclusion.

(iii)             They will ensure secrecy of all matter and pending enquiries with them.

SUBJECT:           REVIVAL / RE-ORGANIZATION OF CRIME RANCH SINDH.

The Government of Sindh vides Home Department Notification No. HD(POL-I)/6/5/2011, dated 20.07.2011 has revived and re-strutted Crime Branch Sindh Therefore the following functions and duties are entrusted to the Addle; IGP Crime Branch Sindh:

(i)                 All the officers / men officers, assets and transport on charge of defunct Crime & Investigation Branch in Sindh will remain at the disposal of Addle; IGP Crime Branch Sindh.

(ii)               The Inspector General of Police Sindh shall fix the authorized strength of each unit of Crime Branch as per requirement from time to time.

FUNCTIONS:

 

(i)                 Addle: IGP Crime Sindh will be staff Officer to IGP Sindh o crime matters.

(ii)               Administrative head of Crime Branch sub-cadre.

(iii)             The organization of Crime Branch throughout the Province shall work under direct command and control of the Addle: IGP Crime Branch Sindh as per the organizational chart given at annex-A.

(iv)             Enquiries / Investigation of cases entrusted to Crime Branch by the IGP Sindh.

(v)               The Crime Branch collecting information and conducted raids in case of arrest and recovery can get the cases registered at concerned Police Station. Investigation of such cases will stand transferred to Crime Branch wherefrom recovery has been affected / accused has been arrested. If any pending case is detected it may also be transferred to Crime Branch and sought legal opinion from PDSP Crime Sindh. (2.7 (I, ii-b) P.M) 21.26 (i.ii,iii) P.R

(vi)             The officers and officials working in Crime Branch for the purpose of any preliminary enquiry or Investigation shall have all the powers of search arrest of persons seizure of property and all other powers duties privileges and liabilities throughout the Province in the respective jurisdiction which a Police officer or is subject in connection with the Investigation of a offences under the Criminal Procedure Code 1898. 2.7 (C-ii & v) P.M

(vii)           The Addle: IGP Crime Branch Sindh will be the overall In charge of the Vigilance Cell in Sindh under the direct supervision of Inspector General of Police Sindh.

(viii)         Complaints against Police Officers / Officials marked by the IGP Sindh.

(ix)             All special drives for the prevention and detection of Crimes. Chapter-2, 2.8 P.M.

(x)               Inter-Provincial Crime Car snatching drugs gun running and other heinous offences. 2.8 (I to iv) P.M.

(xi)             To maintain history sheet of culprits / criminally convicted person. 8.76 P.M.

(xii)           Matter related to Missing Persons, Human Rights, violation (e.g. bonded labour child labour death in custody, oppression / exploitation of woman etc).

(xiii)         Supervision of Forensic Science Laboratories and Forensic Training school in view of compliance the directives of National Judicial Policy, Supreme Court of Pakistan.

(xiv)         Daily Crime Reports of heinous offences for the Province / Compilations of quarterly reports on the working of prosecution Branch and consolidated Annual Administration Reports for the Province.

(xv)           To maintain Criminal Intelligence Gazette and publication of Police Journals. 2.12 (ii & iii) P.M.

(xvi)         Crime Board in accordance with National Judicial Policy.

(xvii)       To arrest the P.Os / absconders and Military Deserters 2.8 (iii) P.M.

(xviii)     Co-ordination with other agencies.

(xix)         Supervision of Assembly Question Cell.

(xx)           To ensure proper implementation of National Judicial Policy.

(xxi)         Any other subject assigned by the IGP Sindh.

This Standing Order shall be implemented forthwith and all pervious Standing Orders issued in this regard are hereby cancelled.

They must ensure prompt fair and professional investigation. They will also ensure that all parties concerned are given full opportunity to adduce their evidence / witnesses / defence, in support of their version which should invariably be brought on record.

  1. In view of the circumstances that in 96% FIRs the number of weapon is not mentioned in FIR with the result same weapon is rotated between different FIRs. Therefore this Order is being issued in the interest of justice and to ensure that wrong practices in investigation process are discouraged.
  1. It would be mandatory for IOs investigating cases in which weapons are involved to mention its make modal and serial number while lodging FIRs.
  1. In case no make / model / serial number is visible on the weapon then it would be sent to nearest Forensic Laboratory for examination wherein Forensic Laboratory will put an indelible mark on the weapon for identification purposes. Mention of this mark number shall be made in the interim final charge sheet before submitting the case in the relevant Court.

Standing Order on Curriculum Development Program of Sindh Police.

This Standing Order No. 268/2012 is being issued to streamline the executing of the Sindh Police Curriculum Development Program in collaboration with NAS.

Program Coordinator:

Mr. Abdul Khalique Shaikh, PSP will be overall coordinator of the Program. His main responsibilities include:

(i)                 Apprising the Inspector General of Police Sindh about progress in connection with the Curriculum Development.

(ii)Coordinating with the Curriculum Development team and meeting deadlines set for the module development.

(iii)             Coordinating with the representatives of NAS.

(iv)             Assign tasks to the Curriculum Development Team (CDT) and monitor their progress.

(v)He will act as Focal Person of the Sindh Police for matters related to the CDT Program.

Curriculum Development Team (CDT):

The training Modules will be developed by the following members of the Curriculum Development Team:

  1. Mr. Niaz Ahmed Siddiqui, former IGP Sindh.
  2. Mr. Tariq Jamil, former CCPO Karachi.
  3. Mr. Muhammad Akbar, Addle. IGP (Rated).

Curriculum Review Committee:

A Curriculum Review Committee is set up to review the quality and contents of the modules developed by the CDT. The Committee will comprise of the following:

  2. Program Coordinator.
  3. Concerned member of the CDT responsibility for developing the module.

Financial Matters:

(i)                 A separate bank account will be opened in a bank with the title of Sindh Police Curriculum Development Program’. The account will be operated jointly by the DIG Finance and the Program Coordinator.

(ii)All payments to the CDT members, vendors and other claimants will be made through cross cheque jointly signed by the above mentioned authorized account operators in accordance with the rate and remuneration mentioned in the PIL signed with the NAS representatives.

Approving Authority:

All payments to the serving and retired Police Officers will be made after the Modules content has been approved by the Curriculum Review Committee and the amount is approved by the Approving Authority. The Appointing Authority will be in the form of a Committee constituting of the following officers:

  1. Addle. IGP Sindh
  2. DIGP HQs
  3. DIG Finance Sindh

The Program Coordinator will maintain record of all the proceeding related to the Curriculum Development Program and its implementation.

STANDING ORDER NO. 269/2012

 

SUBJECT:           POLICY FOR ASSIGNMENT OF SENIORITY TO POLICE OFFICERS MEN WHO HAVE RECENTLY BEEN DEMOTED IN COMPLIANCE OF HONORABLE SUPREME COURT’S ORDER.

OBJECTIVES

  1. This Standing Order is being issued in order to remove anomaly created due to instruction issued from CPO vide Nos. 7493-500/E-II/Insp dated 24.05.2012. No.8116-24/E-II, dated 06.06.2012, 9545-80/E-II/Insp, dated 02.07.2012, & No.9872-900/E-II/Insp dated 06.07.2012.
  1. It shall come into force forthwith to regulate assignment of seniority to Police Personnel who have been demoted in pursuance of Honorable Supreme Court’s order passed in Suo-Moto case No. 03/2012 &CP. No. 492 to 495/2009.

(i)                The demoted officers who have already qualified pre-requisite training course (s) may be given seniority at par with the batch mates.

(ii)             The demoted Police personnel who have not qualified the requisite training/course (s) may be allowed relaxation in age for deputation to pre-requisite courses. However no such officer shall be nominated for any course beyond 55 years of age after getting relaxation.

(iii)           Since it is rigorous and inconvenient for Police personnel who have crossed the age 55 years to go on promotional course (s) according to existing conditions as such the Police Officers / men who have been demoted to their substantive ranks in compliance of Supreme Court of Pakistan’s Order may be given exemption as follow.

Exemption from passing of such courses (not more than once) shall only be allowed to those Police personnel who have been demoted in pursuance of the orders of Honorable Supreme Court of Pakistan and have been over aged to undergo the per-requisite promotional courses.

(iv)             The demoted officer should be nominated for such courses on the first available opportunity.

(v)               If any officer has been promoted / assigned seniority by the orders of respective range head/unit in pursuance of the CPO’s directives discussed in Para-1 above in relaxation of the conditions of qualifying the pre-requisite promotional course (s) all such orders shall be rescined forthwith if the same are issued in contravention of the above policy.

  1. This Standing Order shall only be applied upon Police Officers/men who have been demoted recently in compliance of orders passed by the Honorable Supreme Court of Pakistan Suo-Moto Case No. 03/2012 & C.P. No. 492/495/2009.
  1. In no case such policy shall be applied generally.

STANDING ORDER NO. 270/2012

Management “vehicle Lifting Charges Fund”.

 

1)                  Introduction.

               The Government of Sindh vides Home Department notification no. POL-HD/5-8/2012 dated 28.05.2012 has notified the Policy regarding utilization of funds generated from vehicle lifting/removing charges. According to the policy under reference following amounts are fixed for recovery from the owners / users of vehicle lifted or removed from “No. Parking Zones” under rule 218 of the Motor Vehicle Ordinance, 1969

(i)                 Motorcycle                           Rs 200/-

(ii)               Car/Jeep                               Rs 500/-

2)                  Mechanism of Recovery

(i)                 The DIGP (Traffic) Karachi shall nominate officers not below rank ASI to recover the amount on rates prescribed above or as may be modified by the Government from time to time from the owners / users of the vehicles which are removed from “No Parking Zones” or any other common circulation area via lifters / towing vehicles.

(ii)               A formal receipt (prescribed & authenticated by DIGP Traffic) of the amount recovered / collected on account of lifting / towing charges shall be issued and all amount collected during the day shall be deposited in the bank account to be opened and operated specifically to manage the collection of money collected for the purpose.

(iii)             On or be for e5th of each calendar month the amount collected during the last month shall be reconciled and out of total collection 40% of the amount so collected shall be deposited in the Government Treasury (Account No. 1) of the Government of Sindh while the remaining 60% balance shall be transferred to separate account titled “Lifting / Towing Vehicles charges fund” this account shall be opened and jointly operated by DIGP Traffic Karachi & DIGP/HQ. The funds deposited under this account shall be utilized in a manner prescribed herein after.

3)                  Maintenance of Records

The following documents / record shall be maintained and kept for audit and inspection:

  1. Receipt Book of amount received as Towing Charges from owner / driver in prescribed pro forma attached at Annexure ‘I’.
  1. Towing Vehicle Register in prescribed pro forma at Annexure ‘II’.
  1. File in which the acknowledgment of fine deposited in Account Branch in Traffic Range Office Karachi or as the case may be maintained.
  1. The receipt Book Towing Vehicle Register and file shall be issued from or on behalf of the office of the DIGP / Traffic Karachi. The Receipt Book and Towing Register shall be duly paged and stamped with a certificate on the last page of the Register / Receipt giving out total number of pages.
  1. All documents / record and books of accounts shall be treated as official documents.

4)                  Utilization of Money Collected

i)                    Of the total amount collected 40% shall be deposited in Government Treasury in the Account No. 1 of Government of Sindh on or before 5th of every calendar month.

 

ii)                  60% of the amount collected shall be transferred to the account of titled as “lifting/towing vehicles charges fund” Such account shall be opened in any branch of scheduled bank and shall be operate by two officers not below BS-17 to be nominated by DIGP (Traffic) Provided that IGP Sindh may specify inclusion or addition of any officer outside the Traffic Branch as signature to this account.

 

iii)                That amount collected as Part-ii of the above arrangement i.e. 60% shall further be sub-divided into following categories with percentage as shown against each and incurred accordingly.

5)                  The scope of welfare for Traffic Police Staff shall be as under:

i)                    Main beneficiaries shall be those personnel (BS – 1 to 16) who are mainly / primarily deployed on towing / lifting duties.

ii)                  Medical treatment of Traffic Police personnel (Till re-imbursement of medical charges the amount spent shall be treated as loan).

iii)                For rewarded to personnel in case duty performed on holidays.

iv)                For payment of fees / expense of education of children of Traffic Police personnel in form of scholarship.

6)                  The DIGP / traffic shall be final authority to sanction above expenditure. A formal sanction order shall be issued for claim of payment expenditure.

 

7)                  Loan write off

i)                    In case of death of a personnel the loan shall be “write off”

 

ii)                  In case of default of recovering of loan amount from personnel the loan granted to him shall be written off if it impossible to recover the same for the reason of his / her inability to pay the loan amount subject of final approval by the IGP.

 

8)                  Supervision

The concerned SOs / DSP Traffic of the Traffic Police shall keep closed supervision over the towing vehicle staff of their Section / Sub-Division. They shall check working of the staff daily and sign the Towing Register and relevant papers. They shall ensure that the standing order is followed in letter and spirit.

9)                  Audit

i)                    Annual internal / external audit of this fund shall be ensured by the DIGP / Traffic and also SSP District / Unit Karachi.

ii)                  All registers and registers and counterfoils of the receipt books alongwith audit report shall be retained for a period of ten years after settlement of all audit observations and after ten years the connected record shall be destroyed under order of the DIGP / Traffic.

 

10)              General

There shall no claim as right of any personnel for the grant of loan or reward as case be from this fund or outside the parameters set out under this standing Orders.

STANDING ORDER NO. 274/2013

 

SUBJECT:           DISCIPLINARY ACTION AGAINST POLICE PERSONNEL INVOLVED IN CRIMINAL CASES.

 

In order to streamline the departmental proceedings against Police personnel involved in criminal cases following procedures is hereby ordered:-

(i)                 A Police officer charged with a criminal offence shall immediately be placed under suspension as per provisions of Police Rule 16-19.

(ii)               The concerned district / divisional SP / SSP shall submit a report in writing mentioning the names of Police personnel and brief facts of the case to the office of DIGP concerned as well as to the Establishment Branch of CPO.

(iii)             Disciplinary proceeding shall immediately be initiated against the Police officer (s) charged with a criminal offence by issuing a Show Cause Notice for providing him an opportunity to submit his defence in writing or personal hearing whet ever is applicable.

(iv)             In case of failure to submit the reply of Show Cause Notice final Show Cause Notice on the expiry stipulated period of seven days shall be issued and regular departmental enquiry shall be initiated.

(v)               In case the reply to the Show Cause Notice is not found satisfactory by the competent authority regular departmental proceeding shall be initiated.

(vi)             The departmental action against the Police personnel shall be completed within one month.

(vii)           The final outcome of the departmental proceeding shall be communicated in the matter provided in para-2 above. The office charged with a criminal offence shall be released from suspension as per provisions laid down in Police Rule 16-19.

STANDING ORDER NO. 275/2013

 

SUBJECT:           ESTABLISHMENT OF COUNTER TERRORISM & FINANCIAL CRIME INVESTIGATION WING (CT&FCIW)IN CID CTU, SINDH POLICE.

 

Pakistan has been a victim to the global terrorism. The terrorist organizations are trying to establish their networks inside thickly populated cities and mostly use local manpower and resources to materialize their nefarious designs. For this purpose they need huge chunks of money to finance their terrorist activities. Such financial aid they use to send into the country through informal / illegal channels (Hawala / Hundi) instead of using banking channels. Similarly the terrorists and offenders of other heinous crime like dacoities / bank dacoities, robberies / bank robberies kidnapping for ransom Bhatta collection etc tend to save their ill-gotten money through money laundering. Likewise terrorists had created crime-terror nexus and use different criminal modus operandi to finance and plan terrorist operations within the urban and rural setups. On the other hand local police is not aptly equipped / assigned to pursue and investigate such types of financial crime. As a result these important aspects and financial links remain undiscovered. Presently the FIA and other federal Agencies are handling such cases and frequently requests support from local police. As a matter of fact Police being premier investigation agency in the Country is more likely to deal with criminal cases and terrorist operations having nexus with financial crimes. Therefore it is imperative for Sindh Police to have requisite expertise and capacity to effectively probe such crime. The prevailing circumstances necessitated an urgent need to establish a “Counter Terrorism & Financial Crime Investigation wing” (CT&FCIW) in Sindh Police

  1.  ESTABLISHMENT OF CT&FCIW

Whereas it is expedient to establish a Counter Terrorism and Financial Crime Investigation Wing in Sindh Police to exclusively deal with / Investigate the offences of money Laundering (ML) related to terrorist financing and other heinous offences already declared as “Predicate” offence in the Anti Money Laundering (AML) Act 2010 a Unit herein after called as “Counter Terrorism & Financial Crime Investigation Wing” (CT&FCIW) is hereby established in CID / CTU Sindh with immediate effect and Unit further orders. This Wing will be headed by an officer of the rank of Superintendent of Police (BS – 18) having experience and qualified in international economics & Finance and related fields.

  1. MANDATE & FUNCTIONS

The CT&FCIW shall function as a specialized unit for investigation / dealing with Counter Terrorism and Financial Crimes.

(A)             COUNTER TERRORISM

(i)                 Bomb /IED/VBIED/suicidal blasts.

(ii)               Any sort of terrorist activities.

(iii)             Section Terrorism / Target Killing.

(iv)             Kidnapping for Ransom (money financing for terrorist acts).

(v)               Bhatta Collection (Money financing for terrorist acts)

(vi)             High profile cases assigned by Authority.

(B)              FINANCIAL CRIME INVESTIGATION

(i)                 Money Laundering (ML)

(ii)               Terrorist/Terrorism Financing (TF)

(iii)             Transfer of money through illegal means (Hawala /Hundi)

(iv)             Cyber Crimes.

(v)               All affiliated Crimes

  1. The Wing may initiate such investigations and /or register FIR at its own on receipt of credible information or may investigate a case on its transfer from any other agency / Police Station or Unit by the competent authority.
  1. For the purpose of conducting such investigations the concerned Police officers of this Wing shall have all the powers of “Raid” “Search” and “Arrest” as defined under Police Act and Police Rules or in any other law for the time being in force.
  1. The Wing will proactively target organized criminal networks using legislation in force conduct asset forfeiture / freeze / confiscation in accordance with law with the intention of disrupting their influence and activities through financial deprivation.
  1. The wing shall carry out its functions subject to the laws in force and it will work in collaboration with the Federal Agencies where offences fall under their exclusive domain.
  2. The Wing shall take up the investigation of any case assigned to it and any other task assigned by the IGP Sindh.
  1. ADMINISTRATION

(a)   The Wing shall be under the direct administrative control of Addle IGP CID/CTU Sindh and shall be headed by an officer of the rank of SP (BS – 18) as officer in-charge. The authorized equipment vehicles operational expenses and manpower are at annexure – A and C. the financial / commodities requirement shall be met from the existing CID budget and wherever required full support will be provided by CPO from own resources supplemented with Narcotics Affairs Section (NAS) of US Embassy Islamabad provided commodities which are committed for CT&FCIW.

(b)   The head of the (CT&FCIW) will formulate the detailed SOPs for the working / functioning of the Wing and get it approved / signed by the Addle. IGP CID / CTU Sindh.

(c)    The Addle IGP CID/CTU Sindh will forward the case to authorities concerned for the satisfaction of any legal and codal formalities to eliminate any limitation in the working of the Wing.

Standing Order No. 269/2013

SUBJECT:            POLICE TO REGULATE ASSIGMENT OF SENIORTY IN ACCORDANCE WITH POLICE RULE TO ALL THE POLICE PERSONAL PARTICULARLY TO POLICE OFFICERS MEN WHO WERE DEMOTED IN PURSUANCE OF ORDERS OF HONORABLE SUPREME COURT OF PAKISTAN PASSED IN SUO-MOTO CASE No. 03/2012 & C.P.492 TO 495/2009.

This office Standing Order No. 269/2012 is hereby withdrawn.

  1. Now Standing Order No. 269/2013 is being issued which shall come into force forthwith containing the following instruction/ guideline for regulation of seniority and promotion in accordance with Police Rule of all Police Personal of Sindh Police particularly the Police officers / men who were demoted in pursuance of orders of Honorable Supreme Court of Pakistan passed in Suo-Moto Case No. 03/2012 & CP. No. 492 to 495 /2009:-

(a)          The Seniority of lower subordinate shall be reckoned from dates of appointment under Police Rule 12.2(3) as there is no provision in Police Rule for determination of the seniority accordance to date of passing of mower or Intermediate School Course.

(b)         Ordinarily seniority in age’s hall is given prior consideration in making selection for lower School Course irrespective of the date of admission to list “B” under Police Rule13-7.

(c)          Constable who qualifies the Lower School Course shall be brought on list C-I Promotion to Head Constable shall be made in accordance with principle described in Sub rule 13.1 (1) and (2). The date of admission to List “C” shall not be material but the order of merit in which examination have been passed shall be taken into consideration in comparing qualification. In case where other qualifications are equal seniority in the Police force shall be the deciding factor under Police Rule 13-8. Hence promotion from the rank of PC to HC on list C-I shall be made according to seniority on the basis of date of appointment irrespective of their date of passing Lower School or List C-I.

(d)         Similarly selection for Intermediate School Course shall be made form list C-I. Ordinarily seniority in age shall be given prior consideration in making selection for Intermediate School Course.

(e)          Like-wise list-D be maintained in accordance with date of initial appointment amongst lower subordinate who have qualified Intermediate School Course. Promotion from the rank of HC to0 ASI shall be made in accordance with the principle described in rule 13.1 and seniority amongst direct ASIs and promoted officials be maintained as per provision of Police Rule 12.2 (3).

(f)          However PCs/ HCs superseded or ignored by a duly constituted DPC shall lose their seniority unless the major penalty is set-aside by the appellate authority.

3.                      Apart of above the demoted Police Personal may be assigned seniority as under:-

(i)           The demote officer who have already qualification pre-requisite training Course (s) may given seniority at par with the batch mates from the date of appointment under Police Rule 12.02(3).

(ii)         The demoted Police personal who have not qualified the requisite training / Course (s) may be allowed relaxation in age for deputation to pre-requisite Course as follow:-

However no such officer shall be nominated for any beyond 55 years of age.

(iii)       Seniority of un-qualified Police personal that crossed the age of 55 years shall be settled on list C-II.

(iv)       Exemption from passing one course shall be allowed to all the personnel who were demoted in pursuance of the order of the Honorable Supreme Court of Pakistan. For example:-

(i)                 A demoted Police official who has not passed any promotional course will be exempted A-I/ B-I & Lower School Course.

(ii)               The demoted Police officials who have passed Lower School Course shall be exempted from Intermediate School Course.

(v)         The Above said exemption from passing of such course (not more than once) shall only be allowed to those Police personnel who have been demoted in pursuance of the orders of Honorable Supreme Court of Pakistan and have been over aged to undergo the pre-requisite promotional Courses.

(vi)       The demoted officer should be nominated for such course on the first available opportunity.

(vii)     If any officer has been promoted / assigned seniority by the orders of respective range head / unit in pursuance of the CPO’s directives discussed in para-1 above in relaxation of the conditions of qualifying the pre – requisite promotional course (s) all such orders shall be rescind forthwith if the same are issued in contravention of the above police.

                              The police laid down in para-3 above shall only be applied upon Police Officers / men who have been demoted recently in compliance of orders passed by the Honorable Supreme Court of Pakistan in Suo-Moto case No. 03/2012 & CP No. 492 to 495 / 2009. In no case such policy shall be applied generally.
